Public Art Commission Agreements: Legal and Practical Issues for Sculptors

This webinar will cover the full range of issues that are raised in Public Art Commission agreements. While the Commission Agreements offered by government entities and private developers can vary significantly, the issues that are important to sculptors are the same in both: Design approval, scheduling, the use of sub-contractors like fabricators, payment, copyright, risk of loss and insurance, indemnification, artists moral rights, and dispute resolution. All of these are important terms that should be included in Commission Agreements and will be discussed in detail

About MJ Bogatin:

M.J. Bogatin (“Bo”) is a founding member of the San Francisco Law Firm of Bogatin, Corman & Gold.  

Bo was admitted to the California Bar in 1981.  He is a graduate of Duke University (B.A. 1975, cum laude); University of Essex, U. K. (M.A. in Comparative Literature, 1977); and University of Denver (J.D. 1980).  

Since the founding of Bogatin, Corman & Gold in 1994 in San Francisco, Bo’s own practice emphasis has been Arts and Entertainment, including literary, performing, visual, and film arts transactions.  He regularly handles large-scale Public Art Commissions as well as Visual Artist Moral Rights claims. He has training and experience as a mediator, has served on the boards of directors of several Bay Area theatres, and is an officer and was a long-time President of California Lawyers for the Arts.  He speaks often at legal workshops on copyright, trademark and contract issues for artists. Last year his revision of the LEGAL GUIDE FOR THE VISUAL ARTIST was published by Allworth Press.
